Adoption of separate areas and the instalment of respective management companies
1.1. The parish council does not have this information.
1.2. The adoption process is between principal authorities and landowners / developers.
1.3. The parish council has suggested alternative stewardship models for strategic sites to EDDC, including a menu-based, multi-agency
stewardship model that we feel would work well, with different public bodies and agencies taking responsibility for different aspects in
accordance with their own statutory duties.

At the TRA Sept 2025 meeting, it was passed on by Paula Fernley (EDDC Councillor) that the letter had been sent out in ERROR. First Port are not responsible yet for the Minerva estate.

24/109 COUNCILLOR MOTION: 


TO RESEARCH FUTURE ROLE OF MANANGEMENT COMPANIES AT TITHEBARN AND WESTCLYST 

The Council received a motion from Cllr Paula Fernley to request for some officer time to bring forward a paper on whether adoption of public amenities by the parish council is feasible for Tithebarn (T) and potentially Westclyst (W). 

A discussion was held around the depth/detail of the report to be produced. It was noted that a detailed report could take anything up to 6 months to prepare; it was also noted that NCIL money could be used to engage a project manager prepare a feasibility report. 

Proposal: Cllr Gent proposed removal of the word “potentially” from the motion, seconded by Cllr Fernley. Majority vote. RESOLVED. 

Proposal: Cllr Fernley proposed a revised motion as follows: 

There is a growing movement within the country that Management companies are not great for communities and their pockets. This has been highlighted by the Competition and Mergers Authority (CMAS). Their housebuilding market study, final report recommends mandatory adoption by Parishes.

Motion: I propose a request for Officer time of up to 16 hours to bring forward a high-level paper to the November meeting on whether this is feasible for Tithebarn (T) and Westclyst (W). Movement of the amended motion was seconded by Cllr Gent. 

Vote on the amended motion: 7 in favour, 2 against, majority vote: motion carried. RESOLVED

24/039 PUBLIC QUESTIONS 

Q: Cllr Fernley asked what can the parish council do to assist her and the Tithebarn residents to prepare a paper for residents to consider alternatives to the Management Company. 

A: The Chairman and Clerk will talk with Cllr Fernley. 

Q: Does EDDC yet have a process for accessing CIL money? A: Some additional staff at EDDC have been recruited. Cllr Chamberlain will request an update. It was noted that EDDC is in the process of appointing a CEO.

TITHEBARN COUNTRY PARK MANAGEMENT

It has been reported that the management of the Pinbrook Country Park is not in accordance with the management plan. The council is well-placed to bring pressure on those with responsibility for the maintenance contract, and at the September 2023 meeting, Council resolved that was its agreed position. We were initially led to believe an audit was conducted earlier this autumn; the parish council has not been made aware of its findings. Action: Cllr Fernley will obtain an update on the survey once it has been completed. 


Country Parks – Pinbrook

What Is a Country Park?

Country parks are public green spaces often at the edge of urban areas which provide places to enjoy the outdoors and experience nature in an informal semirural park setting. They provide both local residents and visitors an opportunity for a range of countryside recreational activities, as well as being an important place for wildlife.

Who owns/maintains them?

Country parks are different to usual urban parks, in that nature is encouraged to take over. This means they can be a great place to explore, but won’t be as maintained as you might expect a park to be. The paths and certain areas are maintained by the management company but the rest is left largely to nature, with plants having the opportunity to grow and wildlife to live.

What can I do there?

Country parks are an amazing place to get back to nature. There is a range of things you can do, including a ‘kick about area’ which is more maintained for the kids to play on; a trail around the park which includes natural play equipment around the trail such as wooden balance beams; and is a perfect area for dog walking.

What rules are there?

Visitors should keep to the Countryside code, which has three main aspects:

● Respect everyone: leave gates/property as you find them, do not block driveways/gates, follow signs and keep to marked paths, be considerate to others living in, working in and enjoying the countryside.

● Protect the environment: take your litter home, do not light fires/BBQs, always keep dogs under control and in sight, bag and bin dog poo, generally care for nature and leave no trace of your visit.

● Enjoy the outdoors! Checking local conditions (such as weather!) can help this, and plan your adventure (check out the signs and symbols of the countryside). Google the countryside code and visit the gov.uk website for more information.

Chamonix Estates said “When you purchase a property within the Barratt Homes development at Minerva, in addition to enjoying your new home you will also have the benefit of a number of shared areas. No single property owner will be responsible for maintaining these, and a Management Company has therefore been set up for this purpose on behalf of the owners. All purchasers will become members of this company at the time of legal completion and, when all units have been sold, Resident Directors will be appointed.

Chamonix Estates have been appointed to administer the development on behalf of the Management Company, whose responsibilities include:

Maintenance and repairs to the apartment

block, shared drives, drainage features and

surrounding areas, recreation area, other

pockets of soft landscaping and the country

park

Arranging insurance and statutory inspections

• Holding service charge funds in trust, paying suppliers and providing end-of-year accounts
